Terms of Service

This Terms of Service ("Agreement") is a legally binding contract between you ("User," "you," or "your") and Nova Performance Collection ("Company," "we," "us," or "our") governing your access to and use of this Site, including all information, content, features, and services offered through it.
1. Acceptance of Terms
By accessing or using the Site, you signify that you have read, understood, and agree to be bound by this Agreement and any applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Site.
2. Website Use and Eligibility
2.1 You must be at least 18 years of age to use this Site. By using the Site, you represent and warrant that you are of legal age and have the legal capacity to enter into this Agreement.
2.2 The Site and its content are intended for informational and reservation purposes only in connection with services offered by Nova Performance Collection.
3. Intellectual Property Rights
3.1 All content, trademarks, logos, designs, photographs, videos, text, graphics, and other materials displayed or made available on the Site ("Content") are the property of the Company or its licensors and are protected by applicable intellectual property laws.
3.2 You may not copy, reproduce, modify, distribute, transmit, display, perform, or otherwise use the Content without our prior written permission.
4. User Accounts and Reservation Submissions
4.1 You may be required to create an account or submit personal information to make a reservation through the Site. You agree to provide accurate, current, and complete information, and to promptly update such information as needed.
4.2 You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. We are not liable for any loss or damage resulting from unauthorized access to your account.
4.3 Submitting a reservation through the Site does not constitute a finalized rental agreement. All vehicle rentals are governed by a separate Rental Agreement provided by Nova Performance Collection and subject to approval and availability.
5. Privacy
Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into this Agreement by reference.
6. Prohibited Conduct
You agree not to: Use the Site for any unlawful purpose or in violation of any applicable law or regulation ;Interfere with or disrupt the operation or security of the Site; Attempt to gain unauthorized access to any portion of the Site, accounts, systems, or networks; Transmit any viruses, malware, or other harmful code through the Site; Use any automated means (such as bots or scrapers) to access the Site or extract data without our prior written consent.
7. Third-Party Links
The Site may contain links to third-party websites or services. These links are provided for your convenience only. We do not control and are not responsible for the content, policies, or practices of any third-party websites.
8. Disclaimers
8.1 The Site and its Content are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, completeness, reliability, or availability of the Site or any Content.
8.2 We do not guarantee that the Site will be secure, uninterrupted, or error-free, or that any defects will be corrected.

11. Modifications to Terms
We reserve the right to modify or replace this Agreement at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after any such changes constitutes your acceptance of the revised Terms of Service.
12. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction and venue of the courts located in Windsor, Ontario.
